1. General Framework

1.1 Purpose of the Contract

Moneco is a financial application designed by the African diaspora for the African diaspora in France, which relies on Xpollens to offer Payment Services.

This document defines the Terms and Conditions of the Moneco Application and the terms under which Users can access the Application.

Please read these Terms and Conditions carefully before accepting them. These Terms and Conditions, along with our Price Brochure and Moneco's Personal Data Protection Policy, form a legal agreement (the "Contract") between:

Every User is required to read, accept, and comply with these Terms and Conditions without reservation in order to access the content of the Application. They are provided to the Client in the Moneco Application during registration on the Moneco Application and must be signed prior to accessing our Services. They are then available at all times on our website and in the Moneco Application in the "Legal documentation" section.

1.2 Legal Information of Moneco

The Moneco Application is published by Moneco France.

Moneco France (hereinafter "Moneco") is a joint-stock company registered with the Nanterre Trade and Companies Register under number 915 343 768, with its registered office located at 99 Avenue Achille Peretti 92200 Neuilly-sur-Seine, France, (email: [email protected]).

Moneco is registered with the Prudential and Resolution Control Authority ("ACPR") under number 731771 as a payment services agent of the Xpollens electronic money institution, a simplified joint-stock company with a capital of 64,427,585 euros, with its registered office located at 110 avenue de France 75013 Paris, registered with the Paris Trade and Companies Register under number 501 586 341, (email: [email protected]).

Xpollens is an electronic money institution authorized by the ACPR under bank code (CIB) 16528, to issue and manage electronic money, and/or to provide certain payment services. Xpollens is subject to the supervision of the ACPR (4 place de Budapest, CS 92459, 75436 Paris Cedex 09) and registered on the list of institutions authorized to carry out their activities in France, as published on the website https://www.regafi.fr.

Moneco has called upon Xpollens, which provides payment services (opening of the Payment Account and issuance of an associated Payment Card) ("Payment Services"), under the terms and conditions set out in Xpollens' General Terms and Conditions of Use for the Account and General Terms and Conditions of Use for the Card accepted by the User. Xpollens' Account and Card General Terms and Conditions of Use can be viewed in your Personal Space within the Moneco application and on the Moneco website.

The servers used by the Application are hosted in the AWS Europe (Paris) region by Amazon Web Services (AWS), with its registered office at Tour Carpe Diem, 31 Pl. des Corolles, 92400 Courbevoie and the servers distributed between La Courneuve, Vitry-sur-Seine, and Paris-Saclay.

1.3 Available Languages

This Contract is written and made available to our French resident Clients in French. All communications regarding your Contract will be written in French or in the language you have chosen in your Moneco Application. If these General Conditions are translated into another language, the translation is for informational purposes only and the French version shall remain the official version.

1.4 How and Why Can We Contact You?

We will send you service notifications or other information related to the use of the Moneco Application by email, SMS, or through the Moneco Application. These will be in French or in the language you have chosen in the Moneco Application.

In order to comply with applicable legal and regulatory requirements, we may need to ask you for more information about yourself (for example, if your expenses increase). Please provide us with this information promptly so that it does not cause any problems with your Payment Account or our Services.
