Preamble

The present general terms and conditions of use relate to the use of the Visa Card issued by Xpollens (hereinafter "the Card") in the Google Pay Mobile Payment Solution (hereinafter "the Service"). This Service is subscribed to by the Cardholder (hereinafter "the User") from Xpollens (hereinafter "the Issuer"). They supplement the General Terms and Conditions of Card Operation (hereinafter referred to as the "Card Contract") concluded between the Issuer and the User when the Card is issued, which describes the operation of the Card and the rules for carrying out card payment transactions. The User is advised that the Service can only be subscribed to if he/she has previously agreed to create a Google Account and to be bound vis-à-vis Google by the following conditions: A. B. Use; C. Google Terms of Use; Google Pay/Google Payments Terms of Google Payments Privacy Notice.

ARTICLE 1 - PURPOSE OF THE SERVICE

The Service offered by the Issuer enables the User to register and use his/her eligible Card in a dematerialized manner in the Google Mobile Payment Solution (also referred to as the "Google Pay Mobile Payment Solution" or "Google Pay" in this Agreement). The User can thus carry out card payment transactions, using a device that complies with the service's requirements in terms of system configuration and compatibility (hereinafter "Compatible Device"), without physically using his Card and without having to re-enter his Card data. The Service is based on the Google Pay Mobile Payment Solution. The Google Pay User must download the application linked to the Google Pay Service (hereinafter "Google Wallet Application"), connect to his Google account and add his Card. They must first check that their device is NFC-enabled. Google Pay prompts the User to register his eligible Card in the Google Wallet Application and enables him to pay with it via his compatible Device. Google Pay offers the User a secure payment path, using their compatible Device, enabling them to pay for goods or services quickly and securely with merchants. It also enables the User to consult the latest transactions carried out. Payment transactions carried out by the User using his/her Card registered and used dematerialized in the Google Pay Mobile Payment Solution remain Visa-branded card payment transactions and are governed by the contractual provisions of the Card Contract concluded between the Card Issuer and the User. The User may register several cards in the Google Wallet Application and, in this case, choose the card that will be used by default to make the payment via Google Pay.

ARTICLE 2 - CONDITIONS OF ELIGIBILITY FOR THE SERVICE

2.1 - Users

The Service is open to any individual of legal age, adult under legal protection or minor of at least sixteen years of age represented by his/her legal representative, who holds at least one eligible Card and a compatible Device.

2.2 - Cards eligible for the Service

The Cards that may be registered and used in the Google Pay Solution are those listed below bearing the VISA brand, issued by the Issuer. These may be cards issued to individuals for non-business purposes: Visa Classic, Classic with systematic balance control, Classic with quasi-systematic balance control, Electron, Premier, Platinum or Infinite or commercial cards for business use: Visa Business with systematic balance control, Visa Business Classic, Gold, Platinum. These Cards must be in the User's name and valid. The User is advised that, in the current version of the Google Pay Mobile Payment Solution, the choice of payment on credit with a Debit-Credit card is not possible.

2.3 - Compatible devices

The User must have one of the following compatible devices with NFC (Near Field Communication) functionality: - Android devices running Lollipop 5.0 or later with "Play Protect" certification, a list of which is provided on the Google website; - connected watches equipped with Wear OS 2.0 or later; - Fitbit Versa 4 or Sense 2 connected watches. This list may be supplemented at a later date by other compatible Device models (depending on the development of the Google offer). The User will then be informed by any means. The Google Wallet application and Google Play services must be up to date. -

2.4 - Other conditions

The User must have an Internet connection and compatible software. In order to use the Service, the User must authenticate himself during the Service activation process for his Card, and to this end:

For Cards issued for non-business use: Be equipped with the authentication device offered by the Issuer, which will lead him to authenticate himself by entering his code. The User may also authenticate themselves by using the biometric function of their compatible Device instead of entering their code, if they have set this option. To benefit from the authentication, process the User must be a subscriber to the Issuer's remote banking service, have downloaded the latest version of the Xpollens mobile application onto their compatible Device, and have provided the Issuer with the corresponding telephone number. The User must then activate the authentication on the Xpollens mobile application. For Cards for professional use:

The User may also authenticate himself by using the biometric function of his compatible Device instead of entering his code, if he has set this option. To benefit from the authentication process the User must be a subscriber to the Issuer's remote banking service (or, if his company is the subscriber, have access to his company's remote banking space), have downloaded the latest version of the Xpollens mobile application onto his iPhone, and have provided the Issuer with the corresponding telephone number. The User must then activate the authentication on the Xpollens mobile application.

ARTICLE 3 - SUBSCRIPTION PROCEDURE

3.1 - General provisions

In the case of a User under legal protection who wishes to activate the Service for his/her Card, his/her legal representative accepts the present general conditions of use and authorizes him/her to activate the Service, in the corresponding Card Contract. The present contract is concluded remotely, and the Service is subscribed to, after acceptance by the User of the present terms and conditions of use, as soon as the Service is activated for his Card registered in the Google Wallet Application on his compatible Device. The User is invited to download and/or print these terms and conditions. They are permanently accessible on the Issuer's website. At any time during the contractual relationship, the User may ask the Issuer to send him these general terms and conditions of use on paper or on another durable medium.
