Preamble

These general terms and conditions of use relate to the use of the Visa Card issued by Xpollens (hereinafter "the Card") in the Apple Pay Mobile Payment Solution (hereinafter the "Service"). This Service is subscribed to by the Cardholder (hereinafter "the User") with Xpollens (hereinafter "the Issuer").

They supplement the General Terms and Conditions of Card Operation (hereinafter "Card Agreement") concluded between the Issuer and the User upon the issuance of their Card, which describes the operation of the Card and the rules for executing card payment operations.

The User is warned that the Service can only be subscribed to if they have previously agreed to be bound to Apple by the following conditions, permanently available on the compatible Apple Device (in Settings > Information > Legal Notices): A. Software license agreement for Apple iOS, watchOS or macOS depending on the compatible Apple Device used, including Additional Terms for Apple Pay B. Notifications from Apple C. Apple's Privacy Commitment.

ARTICLE 1 - PURPOSE OF THE SERVICE

The Service offered by the Issuer allows the User to register and use their eligible Card in a dematerialized way in the Apple Pay Mobile Payment Solution (also called "Apple Pay" in this Agreement).

The User can thus carry out card payment operations, using their compatible Apple Device, without physical use of their Card and without having to re-enter their Card data.

The Service is based on the Apple Pay Mobile Payment Solution.

Apple Pay is integrated into the User's compatible Apple Device and relies on the Apple electronic wallet called Cards (hereinafter "Cards Application") present on their compatible Apple Device (one Cards Application per device). Apple Pay leads the User to register their eligible Card in the Cards Application and allows them to pay with it via their compatible Apple Device.

Apple Pay thus offers the User a secure payment journey, with their compatible Apple Device, allowing them to pay, quickly and securely, for goods or services from merchants. It also allows them to consult their latest transactions.

Payment operations carried out by the User using their registered Card and used in a dematerialized way in the Apple Pay Mobile Payment Solution remain card payment operations carried out under the Visa brand and are still governed by the contractual provisions of the Card Agreement concluded between the Card Issuer and the User.

The User can register several cards in the Cards Application and, in this case, choose the card that will be used by default to make payments via Apple Pay.

ARTICLE 2 - SERVICE ELIGIBILITY CONDITIONS

2.1 - Users

The Service is open to any adult natural person with legal capacity, an adult under legal protection, or a minor represented by their legal representative, who is the Holder of at least one eligible Card and a compatible Apple Device, referred to as the User.

2.2 - Cards eligible for the Service

The Cards that can be registered and used in the Apple Pay Mobile Payment Solution are those listed below bearing the VISA brand, issued by the Issuer. These may be cards issued to individuals for non-professional purposes: Visa Classic, Classic with systematic balance control, Classic with quasi-systematic balance control, Electron, Premier, Platinum or Infinite, or commercial cards for professional use: Visa Business with systematic balance control, Visa Business Classic, Gold, Platinum.

These Cards must be in the name of the User and be valid.
